H-1B Visa Lawyer for Michigan Employers and Professionals

H-1B registration, labor condition applications, petitions, transfers, extensions, and amendments for employers and specialty-occupation workers.

Overview

How Mann Law Group helps

The H-1B lets a U.S. employer hire a professional for a role that normally requires at least a bachelor's degree in a specific field, or its equivalent. The rules for the annual lottery, the $100,000 payment requirement, and employer scrutiny changed several times in 2025 and 2026. Mann Law Group helps employers decide whether a role and a candidate fit the category, meet each filing window, and document the position so it survives review.

Common services and issues

Cap registration and the weighted lottery
Most new H-1B workers go through an annual electronic registration, usually in March. Starting with the fiscal year 2027 season, USCIS weights the selection by the wage level the employer offers, so the wage level you choose now affects the odds. We prepare registrations and plan the wage decision with you.
Labor condition application and petition
Before the petition, the employer files a labor condition application with the Department of Labor that covers wages, working conditions, and notice. We prepare the application, the petition, and the evidence that the job is a specialty occupation.
Transfers, extensions, and amendments
A worker already in H-1B status can usually change employers without a new lottery. A change of worksite, duties, or hours can require an amended petition. We track these events so status stays intact.
Cap-exempt employers
Universities, their affiliated nonprofit entities, and nonprofit or government research organizations can file H-1B petitions outside the annual cap. We confirm whether the exemption applies before you plan around it.

What to keep in mind

  • As of September 2026, the $100,000 payment requirement for certain new H-1B petitions is extended by proclamation to September 2027, but a federal court order blocks its enforcement while the appeal continues. This can change quickly. Confirm the current status before you file.
  • An executive order signed on September 18, 2026 directs the agencies to consider recent and planned layoffs of similar U.S. workers when they review H-1B filings. It is not an automatic bar, but employers with recent layoffs should expect more questions.
  • The job must actually require a degree in a specific field. A generic degree requirement, or a role that many people fill without a degree, is a common reason for a request for evidence.
  • H-1B status is generally limited to six years, with exceptions for workers with pending green card cases. Plan the permanent route early.

H-1B hiring in Metro Detroit

Michigan's H-1B employers include automotive suppliers and engineering firms in Oakland and Macomb counties, health systems, universities, and technology companies. H-1B petitions are decided by USCIS service centers, not a local office, so we act for employers across Michigan and for out-of-state companies that hire into Michigan sites. For the permanent step, see our PERM labor certification page.

Common Questions

As of September 2026, a federal court order blocks enforcement of the payment requirement, even though the proclamation was extended to September 2027. The appeal is still pending, and the answer can change. Talk to us before you file a new petition, especially for a worker who is outside the United States.

Starting with the fiscal year 2027 season, a registration receives more entries in the selection when the offered wage is at a higher wage level. A higher wage level improves the odds but does not guarantee selection. The wage must also match the real job.

Usually yes. A new employer can file a petition for a worker who is already in H-1B status, and in many cases the worker can start after the petition is filed. The worker must have maintained status. Get advice before the worker resigns.
